New Regulations in Flanders: Environmental Permit No Longer Required for Certain Works
The Flemish government recently introduced several exemptions concerning environmental permits, which means you no longer need a permit for certain modifications and construction work on your home. This change, published in the Belgian Official Gazette, aims to simplify and make the process more accessible for homeowners looking to modernize or make their homes more sustainable.
Examples of Permit-Exempt Work
You can now insulate your façade without a permit, as long as the insulation is no thicker than 26 centimeters and does not exceed the property line. Additionally, you may install parts of heating and cooling systems, such as air conditioning units and heat pumps, in your front, side, or backyard or on exterior walls without needing a permit—provided they are no closer than 2 meters from the property boundary or adjacent to a dividing wall. Lastly, installing charging stations for electric vehicles on existing paved surfaces is also permit-exempt, as long as no new paving is required.
When Do the New Rules Take Effect?
These new exemptions have been in effect since August 24, marking a significant simplification for those wishing to make their homes more sustainable without getting bogged down in a lengthy administrative process. The publication in the Belgian Official Gazette took place on August 14, making the information widely available.
What to Do If You’re Unsure?
Spatial planning regulations can be complex, particularly as they vary by region. While these new exemptions apply in Flanders, it’s advisable to check specific cases to confirm whether a permit is required. If in doubt, you can contact your local Spatial Planning department or consult the Environmental Permit - Urban Planning Permit section on Belgium.be. There, you will find all the necessary information to determine which rules apply to your specific situation.
